By using or accessing our Services, you (“you,” “your”) agree to be bound by these Terms and Conditions (the “Legal Terms”). If you do not agree with all of these Legal Terms, then you are expressly prohibited from using the Services and must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you by updating the “Last Updated” date. The Services offered by the SBYC Foundation include: access to the Site, information about our charitable work, donation processing, volunteer sign-ups, outreach program descriptions, beneficiary application submissions, and any additional online features we may introduce.
The information provided via the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be illegal or subject to registration. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

These Legal Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the SBYC Foundation is registered and operates (please insert your country of registration). Any dispute will be subject to the exclusive jurisdiction of the courts of that jurisdiction.

13. DISPUTE RESOLUTION

Any dispute, controversy or claim arising out of or relating to these Legal Terms or the Services shall be resolved by negotiation. If not settled within thirty (30) days, it may be referred to and finally resolved by arbitration in accordance with rules of a recognised arbitration institution in the jurisdiction of registration.
You agree to waive the right to participate in a class action.

There may be information on the Services that contains errors or omissions. We reserve the right to correct, update or modify any information at our sole discretion without notice.

16. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SBYC FOUNDATION, ITS OFFICERS, DIRECTORS, VOLUNTEERS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES.
Our total liability for any cause shall be limited to the amount you donated (if any) in the six (6) months prior to the cause of action, or one dollar ($1), whichever is greater.
Some jurisdictions may not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

17. INDEMNIFICATION

You agree to defend, indemnify and hold harmless SBYC Foundation, its officers, volunteers and affiliates from any liability, damage, claim or demand, including reasonable attorneys’ fees, arising out of your misuse of the Services, violation of these Legal Terms, or infringement of any rights of a third party.

18. USER DATA

We will maintain certain data you transmit via the Services for the purpose of managing performance. Although we perform regular backups, you are solely responsible for the data you transmit. We will not be liable for any loss or corruption of your data.

19. ELECTRONIC COMMUNICATIONS, TRANSACTIONS AND SIGNATURES

By using the Services, you agree to receive electronic communications from us (including via email). You consent to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, agreements, and other documents.

If you are a California resident and your complaint has not been satisfactorily resolved, you may contact the Complaint Assistance Unit of the California Department of Consumer Affairs in writing at

21. MISCELLANEOUS

These Legal Terms, along with any policies or rules posted by us, constitute the entire agreement between you and SBYC Foundation. Our failure to exercise any right or provision hereunder does not constitute a waiver of such right.
If any provision of these Legal Terms is held invalid, illegal or unenforceable, the remaining provisions will remain in full force and effect.
You may not assign these Legal Terms without our prior written consent.
There is no joint venture, partnership or agency relationship created between you and SBYC Foundation by your use of the Services.
These Legal Terms are binding upon you and your permitted successors.
